End User License Agreement (EULA)

IMPORTANT – READ CAREFULLY:

This End User License Agreement (“EULA”) is a legal agreement between you (either an individual or a single entity) and Austin Guter, the owner and developer of Retug Software (“Licensor”), governing your use of the Retug Software (“Software”). By installing, copying, or otherwise using the Software, you agree to be bound by the terms of this EULA. If you do not agree to the terms of this EULA, do not install or use the Software.

1. GRANT OF LICENSE

Subject to the terms and conditions of this EULA, the Licensor grants you a non-exclusive, non-transferable license to use the Software solely for your personal or internal business purposes.

2. RESTRICTIONS

You shall not:

• Modify, adapt, translate, or create derivative works of the Software.
• Reverse engineer, decompile, disassemble, or attempt to discover the source code of the Software.
• Rent, lease, lend, sell, redistribute, or sublicense the Software.
• Remove any proprietary notices or labels on the Software.

3. OWNERSHIP

The Software is licensed, not sold. The Licensor retains all right, title, and interest, including all intellectual property rights, in and to the Software.

4. UPDATES

The Licensor may provide updates, upgrades, or enhancements to the Software. Such updates, upgrades, or enhancements will be subject to the terms of this EULA unless accompanied by a separate license.

5. SUPPORT

The Licensor is not obligated to provide any support services for the Software. Any support provided by the Licensor is provided "as is" without warranty of any kind.

6. TERMINATION

This EULA is effective until terminated. Your rights under this EULA will terminate automatically without notice from the Licensor if you fail to comply with any term(s) of this EULA. Upon termination, you must cease all use of the Software and destroy all copies, full or partial, of the Software.

7. DISCLAIMER OF WARRANTIES

THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE LICENSOR DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

8. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE LICENSOR BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER (INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, BUSINESS INTERRUPTION, LOSS OF INFORMATION, OR ANY OTHER PECUNIARY LOSS) ARISING OUT OF THE USE OF OR INABILITY TO USE THE SOFTWARE, EVEN IF THE LICENSOR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

9. GOVERNING LAW

This EULA will be governed by and construed in accordance with the laws of the jurisdiction in which the Licensor is based, without regard to its conflict of laws principles.
